Enables organisations to obtain certification to act as out-of-court dispute resolution bodies (in accordance with Article 21 of Regulation (EU) 2022/2065).

The application must be submitted in electronic form, for example, to the e-address of the Consumer Rights Protection Centre or by e-mail to pasts@ptac.gov.lv.

The application must demonstrate the conformity of the institution with the following requirements:

  1. it is impartial and independent, including financially independent, of online platform providers and of the recipients of the service provided by online platform providers;
  2. it has the necessary expertise in matters arising from one or more specific areas of illegal content, or in the application and enforcement of the rules of one or more types of online platforms that enable it to make a useful contribution to the resolution of the dispute;
  3. the remuneration of its members is not affected by the outcome of the procedure;
  4. the out-of-court settlement of the dispute it offers shall be easily accessible by electronic communications technologies and shall enable the dispute settlement to be initiated and the necessary supporting documents to be submitted online;
  5. it is capable of settling a dispute quickly, efficiently and cost-effectively in at least one of the official languages of the EU institutions;
  6. the out-of-court settlement of the dispute it proposes shall be conducted in accordance with clear and fair rules of procedure which shall be readily and publicly accessible and in accordance with applicable law, including the requirements of DSA Article 21.

The certificate is issued for 5 years. To receive a new certificate, it is necessary to submit a new application.

If a certificate has been received, but it is found that the institution's actions do not comply with Article 21 of the Digital Services Act, then the certificate may be annulled.
